Ain’t Every Medical Malpractice Case About Being a Chicken Thief and Not Getting Caught?

The other day, one of my good friends and great trial lawyers came over and we were working on his case about to go to trial in another state. Now I don’t know much about medicine, but even I recognize a good case when I see one. The  advantage of this case is that it is one that don’t take much imagination or smarts to see the doc screwed up big time.

So you have a villain and now you just need a story. What is apparent to me is that lawyers are scared about med mal cases and going in front of a jury in a small town. Maybe the doctor gets favorable treatment, because if we locals hammer the doc,, we’ll never get another one, they might think. Maybe it’s because the medical profession is held in such high esteem that it ain’t practical to sue these docs, because jurors might not see the mistake and probably will forgive the doc. The legal profession used to have that esteem, but lawyers get sued every day and the public doesn’t have much respect for them.

But one thing I know is that your fear must be personal in front of the jury and maybe the doc is like a chicken thief stealing chickens but not getting caught and getting away with it. I don’t think a jury will protect a chicken thief and when the sheriff catches those chicken thieves,, well, let’s just say more chickens will live because of that sheriff. So isn’t the sheriff the lawyer who brought the suit? Ain’t the jury the ones who will punish the chicken thief? I reckon that the jury can’t send the doc to jail,, so the only thing they can do is award money.

So if you as the sheriff caught the chicken thief who had been getting away with stealing chickens and ain’t got caught yet,, how are we going to punish the chicken thief? Money is the only answer. You know when the jury thinks about someone stealing chickens,, they forget all about this fella being a doctor. Have a nice day,, I’m off to town.
